UPDATE: Congress Moves on Glyphosate Manufacturer Immunity

If you’ve seen claims that pesticide companies were just granted immunity from lawsuits, you’re not alone—but that’s not what actually happened. In recent Farm Bill negotiations, a provision that would have protected manufacturers like Bayer from certain legal claims was put forward and then stripped out after a bipartisan vote. The situation is still evolving, and the details matter. Here’s what was proposed, what lawmakers like Anna Paulina Luna and Thomas Massie did, and what this means moving forward.

What actually happened (April–May 2026)

A provision in the Farm Bill was being pushed that would have given pesticide manufacturers (like Bayer) legal protection. This protection would have limited lawsuits claiming harm, including glyphosate-related cancer cases. What Anna Paulina Luna and Thomas Massie did

  • Luna introduced an amendment to remove those protections
  • The House voted 280–142 (bipartisan) to strip them out
  • Massie publicly supported the removal

What that means in plain terms 1. The “manufacturer immunity” did NOT pass (in the House version) The bill would have protected companies from certain lawsuits. That protection was taken out. So right now:

  • No new federal immunity was granted
  • The attempt to create it was blocked (for now)

2. What the immunity provision would have done, according to lawmakers opposing it, it would have:

  • Limited lawsuits against pesticide companies
  • Overridden some state-level rights to regulate or label products
  • Created what critics described as a “liability shield” for companies like Bayer

3. People are confused online because two different narratives are circulating:

  • “They passed immunity for glyphosate companies” — not what happened
  • “They removed protections for companies” — what actually passed in the House

4. Important: This is not final yet, this was a House vote only. The Farm Bill still has to:

  • Go through the Senate
  • Potentially be changed again
  • Be signed into law

So this is still in progress, not settled. Bottom line

  • There was an effort to give pesticide companies legal protection
  • That protection was removed by amendment
  • The House vote was against manufacturer immunity, not for it
  • The final outcome depends on what happens in the Senate
